1.Agreement
These general terms and conditions (the “Agreement”) govern your access to and use of the Inside-Out Coaching ACADEMY website (the “Inside-Out Coaching ACADEMY Site”) and all online products and services (collectively the “Services”) provided by Inside-Out Coaching Gillian Walter (“Inside-Out Coaching”, “we” or “us”).
By using the Inside-Out Coaching ACADEMY Site, you (“you” or “your”) agree to these terms of service. If you do not agree, do not visit this website, setup an account or use the Inside-Out Coaching ACADEMY Site or the Services.
The Agreement is made effective beginning on the date on which you first create a username and a password on the Inside-Out Coaching ACADEMY Site.
2.Subject of the Services
We offer our Services subscription-based and in monthly modules (one such monthly module, a “Module”). Each calendar month, we will make a new Module available to you on the Inside-Out Coaching ACADEMY Site. We will endeavour to grant you access to the new monthly Module on the first day of the relevant month. One Module corresponds to one monthly subscription. Accordingly, one monthly Module corresponds to a one month’s subscription, three monthly Modules correspond to a three months’ subscription and so on.
During the time of your subscription, you will have access to all Modules that you have subscribed for. Once your subscription ends, your username and password will be blocked and you will no longer have access to the Modules you subscribed for, unless you renew your subscription.
Each Module is dedicated to a theme chosen at our discretion. Services provided in each Module will vary. As a common denominator, you may expect each Module to be structured as follows:
- – One video of an approximative duration of 10 minutes, discussing the monthly theme;
- – One MP3 recording for meditation;
- – One tool to work through;
- – A journaling suggestion;
- – One challenge that we invite you to take on.
As a part of our Services and for the duration of the Module(s) you have subscribed for, you are eligible to use our chat service (the “Chat Service”) allowing you to connect with us and other Chat Service participants. The Chat Service is subject to its own general terms and conditions to which you will have to adhere when subscribing for the Chat Service function. Finally, we make available a Question & Answer tool on our website. Through such tool, you may contact and ask us coaching questions related to the monthly theme of the Module and the Services.
We retain full discretion with respect to the content and the structure of the Modules and particularly reserve the right to deviate from the structure described above.
In addition to the Services, we may offer add-on services including one-to-one coaching sessions, held via video-conference. Such services are not included in the Services and must be ordered and paid separately.
3.Price of Services
Monthly Modules may be purchased at the following costs:
- – One monthly Module: CHF 100
- – 3-month package at a discount of 5% CHF 285
- – 6-month package at a discount of 10% CHF 540
- – 12-month package at a discount of 25% CHF 900
- – 24-month package at a discount of 40% CHF 1440
Discounted packages shall be paid fully in advance. No refund is made if you decide not to use all Modules that you have purchased.
4.Intellectual Property Rights
We hereby grant you a limited, personal, non-transferable, non-sublicensable and non-exclusive license during the Term, as defined below, to use the Inside-Out Coaching ACADEMY Site and its content, exclusively in connection with the Services. All copyrights and all other intellectual property rights offered on the Inside-Out Coaching ACADEMY Site are owned or licensed by Inside-Out Coaching and are protected by applicable copyright law.
You agree that you will not record, copy or make available to a third person any products (including without limitation MP3 videos and audio recordings) available on the Inside-Out Coaching ACADEMY Site, with the exception of your right to personal use or use within a circle of persons closely connected to you, such as relatives or friends, for non-commercial purposes.
Any breach of section 4 of this Agreement shall be deemed a material breach of this Agreement, including for the purpose of its section 7.
5.Use of Data and Data Protection
Inside-Out Coaching shall comply with the Swiss Federal Act on Data Protection. Please refer to our privacy policy which operates as an attachment to this Agreement. The privacy policy is an integral part of this Agreement.
6.Chat Service
The Chat Service further described in section 2 of this Agreement is subject to its own terms of use and policies, including data policy, to which you have to adhere if you wish to use the Chat Service. A breach of any such terms of use or policies, entitles us to momentarily or constantly block the Chat Service for you. Any such blocking will not entitle you to a partial reimbursement of the price that you have paid for the subscribed Modules.
7.Term and Termination of the Agreement
The Agreement is made effective commencing on the date on which you first create a username and a password on the Inside-Out Coaching ACADEMY Site and comes to term on the date on which you request the deletion of your account provided your subscription for the last monthly Module that you have purchased has ended by then(the “Term”).
Where certain sections of this Agreement have effect beyond the Term, such sections shall remain applicable and in full force after the Term (for instance, without limitation, sections 4, 9, 11, 12, 13, 14 and the privacy policy).
If you decide to terminate this Agreement before its Term ends by giving notice to Inside-Out Coaching, then this Agreement will, subject to para. 2 of this section 7, be terminated with immediate effect and your access to the Inside-out Coaching ACADEMY Site will be removed. In case of an early termination of a monthly Module package for convenience, you will forego the applicable discount on a pro rata basis. We shall have the right to terminate this Agreement immediately before its Term ends in case of a material breach by you of this Agreement, including without limitation in case of breach of sections 4 and 6 (breaches which, for the purpose of this section 7, shall always be deemed material). We expressly reserve any claims for damages or indemnification we may have as a result of a material breach you commit.
8.Payments
Payment for services shall be made using one of the available methods on the Inside-Out Coaching ACADEMY Site. Payment can also be accepted by bank transfer to the following account:

The processing of the payments is directly subject to the terms and conditions of the respective service provider. Payment is deemed made once the respective funds have been credited to Inside-Out Coaching.
9.Confidentiality
Inside-Out Coaching undertakes to keep any confidential information that you share during your subscription and the Term with Inside-Out Coaching strictly confidential, except as authorised by you or as required by law. Inside-Out Coaching agrees not to disclose any confidential information pertaining to you to any third party other than employees, consultants and/or service providers of Inside-Out Coaching that are themselves bound to confidentiality. Note that information that you share on the Chat Service is accessible to other participants and subscribers of Modules and is therefore not considered confidential. The terms of any separate confidentiality agreement between you and us shall prevail over this confidentiality provision.
You acknowledge that we are subject to the code of ethics of the International Coach Federation, retrievable under: https://coachfederation.org/code-of-ethics.
10.Disclaimer regarding Medical Services
You confirm that you are aware that coaching is not counselling, psychotherapy, psychoanalysis or any other form of mental health care treatment or therapy, neither is it to be used as a substitute for professional advice by legal, medical, financial, business or other qualified professionals. If appropriate, you will seek independent professional guidance in these areas and you understand that all decisions and actions in these areas are your sole responsibility.
11.Limitation of Liability and Warranties
Under the terms of this Agreement, our liability is excluded, except for gross negligence and wilful misconduct (sections 100 para. 1 and 101 para. 1 of the Swiss Code of Obligations and any other applicable statutory law provision) and except for personal injury or death. You expressly acknowledge and agree that Inside-out Coaching shall not be liable for any direct, indirect, incidental, special, consequential or other damages, including without limitation to damages for loss of profits or intangible losses arising out of or in connection with this Agreement or resulting from the inability to use the Inside-out Coaching ACADEMY Site or the Services, the cost of procurement of substitute services, unauthorized acess to transmissions or alteration of your information or any other matter relating to the Inside-out Coaching ACADEMY Site or the Services.
Inside-out Coaching does not make any representations or warranties in connection with this Agreement, the Inside-out Coaching ACADEMY Site or the Services. We provide our service to you “as is” and without warranty of any kind. Nor do we warrant that the operation thereof will be free of error, that the Inside-out Coaching ACADEMY Site is at all times available or that Inside-Out Coaching will meet special requirements from you. No oral or written information or advice given to you by us or by any of our employees, representatives or service providers will create a warranty for Inside-Out Coaching’s products or services, including the Services, and you may not rely on any such information or advice.
12.Notices
All notices, reports, requests, approvals and other communications under this Agreement shall be addressed to admin@inside-out-coaching.com.
13. Entire Agreemeent, Assignment, Severance and Amendment
This Agreement and the terms and conditions referred to in this Agreement (including the privacy policy and the separate policies for the Chat Services) constitute the entire agreement between you and Inside-Out Coaching and govern your use of the Inside-Out Coaching ACADEMY Site and the Services, superseding any pior agreements between you and Inside-Out Coaching relating thereto.
You may not assign this Agreement to any party. Particularly, you may not grant any third party access to the Inside-Out Coaching ACADEMY Site or the Services. The use of the Inside-Out Coaching ACADEMY Site and the Services is strictly personal.
If any provision of this Agreement is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Agreement will remain in full force and effect.
No modification or amendment of this Agreement, including to this clause, shall be effective unless in writing and signed by duly authorized representatives of both parties. We reserve the right to change and adapt the Agreement from time to time. We will inform you of the changes in appropriate form at least two (2) weeks before the planned entry into force of the new terms of the Agreement. Unless you object to the new terms within two (2) weeks of obtaining such notice, the new terms are deemed accepted. In case you object to such changes, we reserve the right to terminate this Agreement with effect to the new terms’ planned entry into force.
14. Governing Law
This Agreement shall be governed by the substantive laws of Switzerland without respect to conflict of law principles.
